Role of your Conveyancer when you are buying a property:

Ensure the property on the Offer and Acceptance Contract is the correct property you intend to purchase,

Make sure that you’re aware of any encumbrances which could affect your enjoyment of the property,

Ensure you complete all conditions of the contract on time,

Liaise with your lending institution and or finance broker to ensure finance progresses in a timely manner and your lender is in a position to settle on the settlement due date,

Ensure no outstanding orders have been placed on the property by government departments,

Ensure your finances are all available for settlement date and ensure the seller’s agent collects the correct amount on behalf of the seller,

Prepare the correct documentation and ensure you sign it correctly,

Ensure stamp duty (if applicable) is paid in the timeframes specified by State Revenue,

Adjust shire & water rates and ensure they are all paid up to date at the time of settlement,

Attend settlement on your behalf, and finally

Ensure the property is transferred into your name after settlement.

Role of your Conveyancer when you are selling a property:

Ensure the property on the Offer and Acceptance is the correct property you intend to sell,

Ensure you complete all conditions of the contract on time,

Liaise with your lending institution to ensure they will be in a position to remove any mortgages over the property and ensure they’re ready to settle on settlement due date,

Liaise with the buyer’s settlement agent to ensure their finances are in order and they’re ready to settle on time,

Prepare the correct documentation and ensure you sign it correctly,

Adjust shire and water rates and ensure you are reimbursed for the Buyers proportion if you have paid the rates in full for the whole financial year,

Collect the correct amount you are owed by the buyer and distribute as you instruct, and

Attend settlement on your behalf.

 

Subdivision and land developments:

  • Title application for built and mixed used subdivisions, vacant land, green title and strata titles
  • Amalgamation of land and disposition of title

Private sale / purchase transactions:

  • Offer and Acceptance contract preparation
  • Detailing of seller and buyer entities, purchase price, deposit requirements, settlement date and condition timeframes, special conditions of the contract and any other matters applicable to the transaction
  • Provision of copies of the Certificate of Title, Landgate diagram, plan or strata and any encumbrances to the client prior to execution of the contract
  • Provision of the Joint Form of General Conditions of the Sale of Land and Strata Schedules
  • Trust accounting services for deposit monies

Family transfers/related party transactions:

  • Formalising a change of title ownership between spouses, defactos, partners or related parties as a result of choice or court order
  • Formalising ownership share structures
  • Trust and superannuation fund transfers
  • Detailing of stamp duty payable, where applicable

Updating property title particulars:

  • Updating/changing personal details on a title following marriage, address changes or legal change to a name

Deceased estate:

  • Updating the Certificate of Title when a registered proprietor passes away (whether they are a sole proprietor, joint tenant or tenant in common) in order to ensure timely settlement at a future time of sale

Landgate title searches:

Obtaining copies of Certificate of Titles, diagrams, plans, surveys, strata plans, transfers, mortgages, caveats, leases, easements and restrictive covenants from WA’s land and property authority, Landgate=

Landgate document lodgement:

Lodgement of documentation with Landgate, including caveats, withdrawal of caveats, power of attorney documentation and various other documents
